Vacation Accrual Caps and Carryover, Explained

Knowing your accrual rate only tells you half the story. Most employers also cap how much vacation you can bank at once, then apply a separate rule about how much of your unused balance survives into the new year. Those two limits, the accrual cap and the carryover cap, are what actually decide whether the time you’re earning shows up in your balance or quietly disappears. What caps and carryover actually control
An accrual cap (sometimes called a “use it or lose it” ceiling, though that name is a bit misleading) sets a maximum balance you can hold at any point during the year. Once your banked vacation hours hit the cap, accrual stops. You don’t lose hours you’ve already earned, but you stop earning new ones until your balance drops, usually by taking time off.
A carryover cap is a different, separate limit that applies at the end of the plan year (calendar year or anniversary year, depending on the employer). It caps how many unused hours roll over into the next year. Anything above that carryover cap is forfeited, paid out, or lost, depending on the policy and, importantly, the state.
The key distinction: the accrual cap throttles earning during the year; the carryover cap throttles what you keep across the year boundary. A plan can have one, both, or neither. Many employers set the carryover cap lower than the accrual cap on purpose, so employees are pushed to actually schedule time off rather than let a balance pile up indefinitely.
The formula
Accrual Cap Reached When:
Current Balance + New Accrual > Accrual Cap
-> Accrual pauses at the cap; excess hours are not banked
Carryover at Year End:
Carryover Hours = MIN(Unused Balance, Carryover Cap)
Forfeited Hours = MAX(Unused Balance - Carryover Cap, 0)
Both limits are usually expressed in hours, even though your entitlement is often quoted in days. That’s why converting your annual vacation days into hours (what the Vacation Accrual Calculator does) matters here: a cap of “1.5x your annual entitlement” or “40 hours of carryover” only makes sense once everything is in the same unit.
Worked example: accrual cap
Take the calculator’s own example: 15 vacation days a year, an 8-hour workday, paid biweekly. That works out to 120 annual vacation hours and 4.62 hours accrued per pay period.
Suppose the employer sets an accrual cap of 1.5x the annual entitlement, or 180 hours. If an employee rarely takes time off, their balance keeps climbing by 4.62 hours every pay period:
- Balance reaches 175.38 hours: still 4.62 hours below the cap, so the next accrual (175.38 + 4.62 = 180.00) fits exactly.
- Balance reaches 180 hours: the cap. The next pay period’s 4.62 hours are not banked at all, not deferred, not added later. They’re simply not accrued while the balance sits at or above the cap.
- The employee takes a week off, using 40 hours. Balance drops to 140 hours, which is back under the cap, so accrual resumes on the following pay period.
This is why a high accrual cap relative to your per-period rate rarely matters day to day, but a low one (common in some state and public-sector plans) can effectively force you to take vacation regularly or lose accrual outright.
Worked example: carryover at year end
Now take the calculator’s second example: 10 vacation days a year, an 8-hour workday, paid weekly, which is 80 annual vacation hours and 1.54 hours per pay period.
Say this employee ends the year with an unused balance of 95 hours (partly because they carried a small balance in from the prior year too). The employer’s carryover cap is 40 hours.
Carryover Hours = MIN(95, 40) = 40 hours
Forfeited Hours = MAX(95 - 40, 0) = 55 hours
Forty hours cross into the new year as the employee’s starting vacation balance; the other 55 hours are forfeited under a strict use-it-or-lose-it policy, or paid out in cash if the employer’s policy converts excess balance to a payout instead of a forfeiture.
Nuance: state law changes the outcome
The math above is simple, but whether an employer can actually enforce it depends heavily on where the employee works. A number of states, California among the most cited, treat earned vacation as a form of wages once it’s accrued. In those states, an employer can still cap accrual going forward (so a balance simply stops growing at the ceiling), but flatly forfeiting already-earned hours at year end is generally not allowed; unused time typically has to be paid out or carried over in full. Other states let employers write their own carryover and forfeiture rules into policy, as long as those rules are disclosed in advance and applied consistently.
Union contracts and public-sector plans add another layer, often specifying exact carryover ceilings (a fixed number of hours or days) rather than a formula tied to the annual entitlement. When in doubt, the written policy or contract, not a general rule of thumb, governs what happens to your specific balance.
FAQ
Is an accrual cap the same as a “use it or lose it” policy? Not quite. A “use it or lose it” cap stops new accrual once you hit the ceiling, but doesn’t take away hours you’ve already earned. True forfeiture, losing earned hours outright, is a separate and more legally restricted practice that applies mainly to carryover at year end, not to the accrual cap itself.
Can my employer just pay me out instead of letting hours carry over? Many do, and in states where forfeiture of earned vacation isn’t allowed, a payout for the amount above the carryover cap is a common compliant alternative. Whether it’s required, optional, or not offered at all depends on the employer’s policy and, again, state law.
Does the accrual cap reset when I take time off? Yes. The cap is a ceiling on your current balance, not a one-time trigger. As soon as time off brings your balance back below the cap, accrual resumes on the next pay period as if the pause never happened.
